Frequently Asked Questions

Have a question that is not listed here? Speak directly with a senior partner.

Ask an advisor
What is the minimum investment required?

$800,000 for projects in a Targeted Employment Area or qualifying infrastructure project, and $1,050,000 for standard projects. These amounts are scheduled for an inflation adjustment from 1 January 2027.

What is concurrent filing and who qualifies?

If you are in the U.S. in lawful status, such as on an H-1B, F-1 or L-1 visa, you may be able to file Form I-485 together with your I-526E petition when a visa number is available. This lets you apply for work and travel permits while your case is pending.

Can my spouse and children be included?

Yes. Your spouse and unmarried children under 21 can be included in a single investment petition.

What counts as an acceptable source of funds?

USCIS needs a clear, documented and lawful trail for all invested money. Common sources are salary and savings, business profits, property sales, investment portfolios, lawful gifts and loans secured by your own assets.

Is an EB-5 investment risk free?

No. U.S. law requires EB-5 capital to be at risk, and repayment cannot be guaranteed. That is why we focus on due diligence, capital structure, developer track record and repayment strategy.

How does ArcAsia Advisors help through the process?

We guide you from the first eligibility review through project selection, source of funds preparation, cross-border transfers and coordination with licensed U.S. immigration attorneys, through to the I-829 petition and return of capital.
